🚨 Service & Usage Agreement

This Service & Usage Agreement (“Agreement”) governs the use of services provided by MuzzHost, backed by Muzztech. This Agreement applies to all users worldwide.

By using our services, you agree to strictly comply with all provisions outlined below.

1. Scope of Agreement

This Agreement applies to all services including but not limited to:

• Shared Hosting, VPS, Dedicated Servers
• Domain and DNS Services
• Email, SSL, and infrastructure services

This document governs how services may be used, not legal ownership or billing (covered under Terms of Service).

2. Absolute User Responsibility

You are fully and solely responsible for:

• All activity under your account
• All content hosted, transmitted, or stored
• Any misuse of services, whether authorized or unauthorized

⚠️ “I didn’t do it” is NOT a valid defense if it occurred under your account.

3. Zero-Tolerance Acceptable Use Policy (AUP)

🚫 Strictly Prohibited Activities

You may NOT use our services for:

3.1 Illegal Activities

• Any violation of Indian law or international law
• Fraud, scams, impersonation, or financial abuse

3.2 Security Abuse

• Hacking, brute force, port scanning
• Exploiting vulnerabilities
• Unauthorized access attempts

3.3 Network Abuse

• DDoS attacks or traffic flooding
• Any activity degrading network performance

3.4 Malware & Exploits

• Hosting or distributing malware, ransomware, spyware
• Running exploit kits or malicious scripts

3.5 Content Violations

• Copyright infringement / pirated content
• Adult content (if restricted by infrastructure/provider)
• Hate, abusive, or illegal content

3.6 Email Abuse (STRICT)

• Spam (bulk unsolicited emails)
• Email spoofing or phishing
• Blacklisted IP usage

👉 ANY violation = immediate suspension WITHOUT notice and WITHOUT refund

4. Aggressive Fair Usage Policy (FUP)

“Unlimited” ≠ unlimited.

🚫 Strictly Prohibited Usage:

• Using hosting as cloud storage
• Backup/archive systems
• File sharing / download portals
• Media streaming at scale

⚠️ Resource Abuse Includes:

• High CPU spikes
• Excess RAM or disk I/O
• Excessive database usage

👉 We may:

• Throttle performance
• Suspend instantly
• Force upgrade

No warning required.

5. Real-Time Abuse Enforcement

We operate a zero-delay enforcement system.

We may:

• Suspend accounts instantly
• Block IPs / ports
• Remove content without notice
• Disable services at infrastructure level

⚠️ No prior notice will be given in abuse or risk scenarios.

6. Data Responsibility (STRICT)

• You are 100% responsible for your data
• We do NOT guarantee backups
• Backup systems (if any) are best-effort only

👉 We are NOT liable for:

• Data loss
• Corruption
• Failed restoration

7. Compromised Account Policy

If your account is:

• Hacked
• Infected
• Misused

We may:

• Suspend immediately
• Isolate or delete affected data

Restoration may require paid cleanup or manual review.

8. Email & IP Reputation Protection

To protect infrastructure:

• We monitor outgoing emails
• We enforce strict anti-spam policies

If your account causes:

• IP blacklisting
• Spam complaints

👉 We may:

• Disable email services
• Suspend account
• Impose cleanup or penalty fees

9. Third-Party Dependency Disclaimer

• Services may rely on external providers
• We are NOT responsible for outages, failures, or limitations

10. Monitoring & Surveillance Rights

We reserve the right to:

• Monitor system activity
• Inspect traffic patterns
• Investigate suspicious behavior

This is required for security and compliance.

11. Global Compliance Clause

• Users must comply with BOTH:
  • Indian law (primary jurisdiction)
  • Their local country laws

👉 Using our service to bypass laws = violation

12. Suspension & Termination Authority

We have full authority to:

• Suspend services without notice
• Terminate accounts permanently
• Delete data where necessary

No justification required in critical cases.

13. No Refund Clause for Violations

• Any suspension due to policy violation = NO REFUND
• Abuse-related terminations are final and non-negotiable

14. Chargeback Abuse Protection

If you:

• File a chargeback without contacting support

👉 We may:

• Permanently terminate account
• Block future access
• Recover dues legally

15. Reseller Responsibility Clause

If you are a reseller:

• You are responsible for ALL your clients
• Your clients’ violations = YOUR liability

👉 We may suspend entire reseller account.

16. IP Blocking & Blacklist Authority

We reserve the right to:

• Block IP addresses
• Restrict geographic regions
• Deny access based on risk analysis

17. Force Protection Clause

We may take any action required to:

• Protect infrastructure
• Prevent downtime
• Ensure network stability

Even if it impacts your services.

18. Policy Override Clause

This Agreement overrides:

• Marketing claims (like “unlimited”)
• Verbal commitments
• Misinterpretations

19. Updates & Enforcement

• Policy may change anytime without notice
• Continued usage = acceptance

20. Acknowledgment

By using MuzzHost services, you:

• Accept full responsibility
• Agree to strict enforcement
• Waive claims arising from misuse
